Who will get my stuff?

Your spouse (married or more than two year de facto) will get everything. This is true even if you have children from a previous relationship.

If you don’t have a spouse but do have children, then your money and property is divided equally between all the children. In the case where one of your children is dead, their share will go to their children (your grandchildren of that child).

If you don’t have children, grand-children or great-grandchildren, then your money and stuff will go to the following people (in order of priority): your parents, your brothers and sisters, your nephews and nieces, your grand-parents, your uncles and aunties and finally your cousins.

If you do not have any of these people, your money and property will become the government’s.

Note: In-laws and step-parents/step-children have no legal rights to your money or property.
